Happy Birthday Anyah ! We miss you !




 THIS IS NO ACCIDENT, THIS IS NEGLIGENCE

 Our mission is to find justice, accountability, and eventually closure in the death of Anyah Raven Glossinger.  We are determined to spread her message, and we are dedicated to advocate and persevere in our quest for equality and quality of life for Autistic children. 

1 in 150 children have Autism. It is time for the state and local authority to learn the autistim spectrum and catch up to a gripping and explosive epidemic.  They need to catch up today! Autistic children and their families who are victimized deserve the same protection of the law as other children. We believe they may not be getting it. State and local authorities need to create and enforce laws that are adaptive to the needs and rights of the autistic community.

The recent death of 5 year old Anyah Raven Glossinger, an autistic and visually impaired girl with the developmental level of a 24 month old, raises a number of moral, political, judicial, and ethical issues that require immediate attention. It brings about questions of quality in care, discrimination, and a system that may  be failing the autistic community. These questions stem from the outcome of the traumatic and avoidable January 23rd 2008.  Professional caregivers through a program licensed by the state were responsible for the well being of Anyah, they left her in the water as the only child not provided a life vest, without a voice, without the cognitive ability to fight for her life, they turned their backs on her until she was in cardiac arrest. They lied to the community, themselves, Anyah's mother, the police, and each other.

"It was only a matter of time until this happened" said a CA. state agent during the course of the investigation, as if the ticking time bomb that had sat right under the surfice had finally blown.
Anyah's death prompted police to suggest charges against her caretakers of negligent manslaughter.  To add insult to injury the D.A declined to file charges of even child endangerment stating there was too little evidence. Her death prompted an investigation by the state of California into a program ran by a nationwide organization for disabled children.  Then a laundry list of disturbing findings forced the state of California to close the program permanently. 

What would have been different if the state and regional agencies responsible for overseeing the program had done their part.  What may have been prevented if the program was monitored properly, if regulations and licensing requirements were enforced?
The answer is Anyah might still be alive.

This case is still open with the Riverside County District Attorney and they are said to be waiting on new evidence.  Learn about the message her mother is spreading in her daughters memory, the ongoing fight for justice, and her quest for new laws.

How can this be no justice yet for my baby.

You were taken from us that fatal day, as I waited at home thinking you were perfectly safe. 
They took you away, when they brought you where you weren't supposed to play. 
When strangers decided you would be in better hands, they did so with out even a back up plan.
They turned around, leaving you to drown.
Without a voice or a helping hand, then hoped that I wouldn't make a stand.
 As you slipped from the life that I had planned, you trusted them dear, 
now I live in sorrow and fear.

I am left wondering how can this be, no justice yet for my baby. 

I have to ask who is to blame as everyone continues to play the red tape game.
The facts all point a certain way, to the negligent events that happened that day.
Now you are gone and all they can say, is inaccurate accounts of your unnatural fate.
So again I wonder how can this be, as each day passes filled with grief, and still no justice yet for my baby. 

The coroner checks the box next to "accidental death", and the media forgets there is NO box for "death caused by negligence".
The Police and detectives say they are on our side, do they really think I will sit back and go along for the ride. 
They ask for negligent manslaughter and so does the state. 
The D.A says NO WAY because....
 "in drowning cases the odds of convictions aren't so great". 
Yet all do say they have done there best, however still not one arrest!
They suggest corporate liability, but shelf it all like an over read book, assuming no one will ever be on the hook.
But they are wrong in so many ways, I am on the hook each and every day.
I have been hooked by a dagger of greif, loss, and fear, and through it all I must persevere. 
They tell my attorney to bring them more evidence, as if whats already in front of them is completely irrelevant.

We need to join together and raise our voice in the name of Anyah who had no choice.
It is well overdue time for those to pay, for the precious life they put in harms way.

 These failures start at state and governmental levels, and stretch all the
way down to the bowels of the poorly constructed non profits and their petty inexperienced employees who stand around holding policy and procedure handbooks written in crayon by morally starved executive directors. 
   
   We are taught that our system is indeed capable of providing for the safety, health,
and welfare of the weakest members of our society.  The poor construction of this system
and the vast margins of error that have been weaved into it's design should be on the forefront
of California's fix it list.  For this is not the first time, however this time, it was my
 angel that died.  Every single loss of life is a catastrophic loss.

                                                                -THE DETAILS-

This is a case where the system failed resulting in the death of an innocent child.
The State Department of Social Services, the Department of Community Care and
Licensing, the Inland Regional Center (responsible for overseeing the program), 
the United Cerebral Palsy Organization, it's executives,
and employees all failed to adequately meet the needs of all the children in care
resulting in a preventable death and the repercussions are still unraveling.

·               Anyah Glossinger had low functioning Autism and had been a consumer of
The United Cerebral Palsy's "Dennis James Center" and it's programs and
services for 2 years. She had the developmental level of an 18-24 month old.

·               On  January 23rd, 2008 Anyah was taken swimming at a hydrotherapy pool.
Her parents were informed 6 months prior that Anyah would no longer be
 taken to the pool for multiple reasons. She was one of three children
accompanied by three coaches. Each child being on a I: I ratio
(by contract with the state).

·               Anyah was the only child that was not provided with a life vest.
She was left in the water unattended without a legal life saving
preserver which was provided to the others and she drowned as a result.
She died the next day at Lorna Linda University Children's Hospital.

·               This prompted an investigation that focused on two of the three coaches.
One of the coaches sent out a text message from her phone at approximately
 the same time Anyah went under the water while the other coach was in
the bathroom.

·               Anyah's blood gas levels showed a minimum down time of 15-20 minutes.
The statement given to police by the coaches was that she was under water
for one minute. This contradicts the medical facts and the time line.

·               The local press has consistently covered the story. In February an article in
The Press Enterprise was released titled "Girls death reported to state weeks
late in investigation, in second incident since December."
By law United Cerebral
 Palsy was required to report Anyah's death to Social Services & Community Care
and Licensing within 24 hours.  Her death was not reported to the state for 5weeks.

·               Documents apparently disappeared and signatures "may have been" forged
during the five week period that the family attempted to obtain the agencies
official records of the incident.

·               Several state agencies joined the investigation. The center was closed by the
state of California citing numerous violations, including but not limited to;

COPIED FROM STATES INVESTIGATION FINDINGS:
“failed to provide adequate supervision to prevent a child from drowning"                                                                                               
"Staff violated child to staff ratio requirement" 
 "Child care center was found incompetent to provide services necessary
to provide for individual needs"
"Staff failed to meet the needs of Anyah when they allowed her to drown
and failed to notice her in distress or danger until  it was too late"        
"Failed to report changes of the board of directors"     
 "Program operating outside of compliance for more than a year in several areas"                                    
"Facility failed to report the death of a child in care within 24 hours"                  
"Changes in director - information was not reported but discovered
throughout the investigation"                                                            
 "No qualified director was present"
"Current director does not have education"                                                                         
"Licensee failed to report changes in the operation of the facility
where they would now be providing tube feeding for children"                                                                                                              
                                                                             
 
"lack of criminal background checks for employees"

     The Angel View pool and spa facility was closed by the Department of Environmental
      Health and is currently under an open investigation for the possibility of numerous
      repetitive infractions and violations of pool and spa safety codes.

      During the course of the investigation Anyah's mother found the coaches and director
of UCP involved in the incident on a My Space chat room during the day of the
child's funeral ranking their moods as "happy" and posting dirty jokes on each
other’s sites.

      The police department briefed the Riverside County District Attorney’s office on the case
 and suggested charges of negligent manslaughter and child endangerment on the
 29th of May.

       The Riverside County District Attorney’s office decline to file charges. Stating it was too
 hard to get a jury to convict on negligent drowning cases.

       The two coaches involved in the incident were also working with special needs children in
 the Palm Springs Unified School District. 
They were put on administrative leave pending
 the criminal investigation. The coverage of this story turned into a national news brief.
They have recently been accepted back to work due to the county's decision not to file
 charges against them. We are under the impression that the two coaches have now returned
 to work with special needs children. 

       Anyah's Mother has met with the District Attorney twice since their decision. She requested
 both meetings in her fight for justice for her daughter and this case currently remains open.
